ERA 2025: Written Statements of Employment — Updated Requirements
Written statements of employment particulars — the document setting out key terms of employment — must now be provided on or before the first day of work. The ERA 2025 builds on changes introduced in 2020, which made day one statements mandatory, and extends the information they must contain.
Among the additions: the statement must now reference the employer's right to make deductions from pay, any probationary period length and conditions, and — for zero-hours or irregular-hours workers — an explanation of how work will be offered and what a worker can do if they believe their pattern qualifies for guaranteed hours.
Mellow generates employment contracts that include all required particulars. New hire onboarding triggers the contract creation workflow and logs when it is sent and when the employee acknowledges receipt. A missing or incomplete written statement is itself a tribunal matter under ERA 2025 — workers can claim up to four weeks' pay as a result. Getting the document right from day one is the simplest way to avoid that.
